I completely support Dr. Baehren’s argument in favor of liability protections for emergency and on-call physicians, and I suspect just about all emergency providers would also (“Let My People Go,” April 2012, p. 2). If only he had not muddied the waters by linking this with a discussion of the constitutionality of the individual mandate and insurance coverage of contraception.

ACEP News: Vol 31 – No 06 – June 2012I suspect many emergency physicians are very supportive of reproductive rights and the right to basic health care and thus disagree very strongly with his “constitutional” arguments against the Affordable Care Act. I don’t know how the Supreme Court will decide this issue, but I can almost guarantee that the decision will be a split along party lines – just proving that this is a political, not a constitutional, issue.
